Interim Report: The Right to Enter

This report has five sections: Introductory section provides definitions of some key terms and contextualization of the right to enter in relation to State sovereignty and jurisdictional issues. Section two deals with the international legal framework of the right to enter, including brief discussion on international human rights law and international refugee law and then focusing on treaties, customary international law, general principles of law and soft law in relation to international migration law. The third section focuses on the right to enter for nationals and the fourth section deals with the right to enter of aliens, including those aliens entering ‘their own country’ but not the country of nationality, the principle of non-refoulement, family reunification, and stateless persons. The last section is on antidiscrimination in the context of the right to enter.
