Submission by the Office of the United Nations High Commissioner for Refugees in the case of 2020HunGa1 and 2020HunBa119 before the Constitutional Court of the Republic of Korea

In this submission, UNHCR addresses the fundamental principles of non-refoulement and the right to seek asylum. UNHCR then provides its interpretation of the relevant principles of international refugee and human rights law on the arbitrary detention of asylum-seekers and highlights substantive safeguards. It further underlines that the principles related to the detention of asylum-seekers apply a fortiori to children.
