Prima facie status and refugee protection

The determination of refugee status on a group basis gives rise to a number of questions. This paper attempts to answer these questions by way of deductive reasoning from international instruments on refugees and by examining state practice, focusing on the experience in Africa. This paper suggests that the principal triggering factors for employing the prima facie approach should be the objective circumstances which led to mass displacement and the scale of displacement.
