R (on the application of SS) v. Secretary of State for the Home Department

The claimant arrived in the UK on 4 November 2002 from the GCI. The SSHD denied his claim for asylum in December 2002 on the ground that it could not be factually established that he was from Iraq. In November 2003, the adjudicator denied the claimant's appeal, but established that the claimant was in fact from GCI. In September 2006, the claimant submitted an application for indefinite leave to remain in reliance upon the 2006 Policy. The SSHD denied the application on the basis that it had not been established that he was from the GCI during the time that the policy was operative. By the time it was accepted that he was from GCI in 2003, the policy was no longer in force.
