A representative of a private insurance company in Georgetown, Guyana, stated in a 3 June 2004 telephone interview that vehicle insurance to cover damages to third parties is mandatory in Guyana. The representative further stated that insurance to cover damages to the driver or owner of the vehicle and his or her property is not mandatory but is available for purchase from private insurance providers.
The amount of mandatory coverage required, as outlined in Section 4(3)(a) of Guyana's Motor Vehicles Insurance (Third Party Risks) Act (1998), is, in the opinion of the representative of the insurance company, "very small" and "not adequate" when seen in light of the high cost of purchasing a vehicle in Guyana (3 June 2004).
Section 3 (1) of the Motor Vehicles Insurance (Third Party Risks) Act (1998) states that
[s]ubject to this Act, it shall not be lawful for any person to use or to cause or permit any other person to use a motor vehicle on a public road unless there is in force in relation to the user of the vehicle, by that person or that other person, as the case may be, such a policy of insurance in respect of third party risks as complies with the requirements of this Act.
