I. RESOLUTIONS ADOPTED ON THE REPORTS OF THE SIXTH COMMITTEE 89. Authorization of the Economic and Social Council to request Advisory Opinions of the International Court of Justice
The General Assembly, under Article 96, paragraph 2, of the Charter, is empowered to authorize other organs of the United Nations and specialized agencies to request advisory opinions of the International Court of Justice on legal questions arising within the scope of their activities. The Economic and Social Council, as one of the principal organs of the United Nations and by virtue of the functions and powers conferred upon it under Chapter X of the Charter of the United Nations, has wide responsibilities in diverse fields of economic and social co-operation, in the fulfilment of which it may need to request advisory opinions of the International Court of Justice. In addition, by virtue of the terms of Article 63 of the Charter, the function of co-ordinating the activities of specialized agencies brought into relationship with the United Nations has been conferred upon the Economic and Social Council. To enable the Council adequately to discharge its co-ordinating responsibility, it should be authorized to request advisory opinions on all legal questions within its scope, including legal questions concerning mutual relationships of the United Nations and the specialized agencies. The General .Assembly, therefore, authorizes the Economic and Social Council to request advisory opinions of the International Court of Justice on legal questions arising within the scope of the activities of the Council.
