Africa Events of February 1992, states that the Union of Patriots for the Liberation of Kenya (MWAKENYA) refused to register as a political party/movement arguing that the removal of Clause 2A from the Constitution of Kenya does not constitute fundamental changes on the Kenyan political scene. Reportedly, Clause 2A was the clause that made Kenya a uniparty state (Africa Events Feb. 1992). According to a spokesperson for MWAKENYA, Ngugi wa Thiongo, the other reason for not registering is that President Arap Moi declared MWAKENYA his "enemy number one" and has not changed his position on this declaration. The spokesperson stated that "the offical position is that MWAKENYA has not the slightest intention of seeking registration under the Moi-KANU regime" (Ibid).

The spokesperson, however, maintains that MWAKENYA is a political party and movement which has been in existence since 1974 and whose legitimacy is rooted in the Kenyan people and not in the registration exercise (Ibid).
