Decision No. 790/1993 of the Suspension Commission of the Council of State

Summary of facts:The Applicant is an ethnic Palestinian born in Syria. An order of deportation against him was issued by the MPO General Secretary. He appealed against this decision, applying also for temporary judicial protection. He claimed and proved, before the Committee, that all the members of his family, save a brother of his detained for political reasons in Syria, were in Australia and had Australian citizenship. A family member had invited him to immigrate to Australia. To confirm his claim, he produced a relevant certificate issued by UNHCR.

Reasoning and decision:The Committee took note of all facts in the case and decided that a temporary suspension of the enforcement of the deportation order was justified, in particular since this order did not invoke a specific reason of public interest. 

The Committee granted temporary suspension of the enforcement of the deportation order.
