THE ROYAL GOVERNMENT

-Having seen the Constitution of the Kingdom of Cambodia,

-Having the Royal-Decree, dated 24 September 1993, on the Appointment of the 1st and 2nd Prime Ministers,

-Having seen the Royal-Decree, dated 01 November 1993, on the Appointment of the Royal Government of Cambodia,

-Having seen the Royal-kram (Law) nº 02 NS-94, dated 20 July 1994, on the organization and Functioning of the Council of Ministers,

-Having seen the Royal-decree nº NS-Roy-decr.-1094-83, dated 24 October 1994, on Modification of Composition of the Royal Government of Cambodia,

-Having seen the Royal-Decree nº NS-Roy-Decr-1094-90, dated 31 October 1994, on Modification of Composition of the Royal Government of Cambodia,

-Having seen the Royal-Kram (Law) Nº NS Roy-Kr-196-08, dated 24 January 1996, on the Establishment of the Ministry of Interior,

-Having seen the Sub-Decree nº 16 Sub-Decr, dated 20 December 1993, on the Organization and Functioning of the Ministry of Interior,

-Following the proposal of the Ministry of Interior,

-Following the approval of the Council of Ministers,

DECIDES:

ARTICLE 1:

Khmer Nationality Identity Cards shall be established in accordance with the sample as mentioned in the Annex to this present Sub-decree.

ARTICLE 2:

Khmer Nationality Identity cards, shall be valid for 10 (ten) years, from the date of issuance of its issuance.

ARTICLE 3:

Khmer Nationality Identity Cards, may be granted only to khmer citizens of both sex of 18 years old and above.

ARTICLE 4:

While issuing Khmer National Identity Cards, the authority shall consider on:

-the Birth Registration Certificate, or

-the Judgement of the Court certifying its recognition such person is born from a parent (mother or father) which has Khmer nationality, or

-the Royal-decree proclaiming the recognition the demand for nationality of the concerned person, or

-the Royal-decree proclaiming the request for Khmer nationality of the concerned person, or

-the document or evidence proving that the concerned person used to have Khmer nationality before, or

-the document or evidence proving that the concerned person was born in Cambodia, from a parent (mother or father) who was born in Cambodia, or

-Any document which may indicate that such person is a Khmer citizen.

When issuing Khmer Nationality Identity Cards, the competent officials shall be personally liable for the penalties under the nationality law in case if they issue Khmer nationality identity cards to any person who has no Khmer nationality.

ARTICLE 5:

In the formality for the application for Khmer nationality identity cards, the recognition of evidences which prove of the nationality, shall be determined by a Proclamation of the Ministry of Interior and with an approval from the Royal Government.

ARTICLE 6:

Only an official who is holding position as a governor of province or municipality may be a competent official in the issuance of Khmer Nationality Identity Cards.

This official may not transfer or delegate this power to any other official.

ARTICLE 7:

The applicant for Khmer Nationality Identity Cards shall be liable to pay tax according to what determined in an inter-ministerial Proclamation (Prakas) of the Ministry of Interior and the Ministry of Finance and Economy.

ARTICLE 8:

This above collected tax, shall goes into the national budget.

Procedure for the collection of this above tax, shall be determined in by an inter-ministerial Proclamation of the Ministry of Interior and the Ministry of Finance and Economy.

ARTICLE 9:

Any provisions which are contrary to this present Sub-decree, shall be null and void.

ARTICLE 10:

This Co-ministers in charge of the Council of Ministers, Co-ministers of Interior, Minister of Justice, Co-Ministers of National Defence, Minister of Foreign Affairs and International Cooperation, Minister of Economy and Finance, Minister of Public Functions, all Chiefs of the relevant institutions, shall undertake to implement this Sub-Decree, from the day of its signature and so forth.
