Decision No. 791/1993 of the Committee of Injunctions of the Council of State

Summary of facts: The Applicant is a third country national, wife of a Greek national. She came to Greece in 1989 and married a Greek national, killed in 1992. She was in possession of a residence permit valid till 1993, but the MPO rejected her application to renew it. She appealed against this decision of the State Security Directorate and requested temporary judicial protection. She claimed that an immediate enforcement of her expulsion would provoke irreparable damage to her interests, since she had inherited land property from her late husband that she would not have been able to manage if she left the country; that she also had deposited money in a Bank that she could not send abroad where she had no income; and finally that her departure would not allow her to be present, as a civil part, in the trial of the person accused for her husband's murder. 

Reasoning and decision: The Committee decided to suspend provisionally the enforcement of the said decision, for the part concerning the Applicant's departure from Greece. 

The Committee granted temporary suspension of the enforcement of the deportation order.
