Russian Federation: Decision of 1994 of the Government on Additional Measures concerning State Regulation of Migration in the Krasnodar Territory

To improve the state regulation of migration in the Krasnodar territory and comply with the Decree of President of the Russian Federation of September 16, 1993 No 2145 "On Measures to Ensure Immigration Control" the Government of the Russian Federation shall decide:

1. The Federal Migration Service of Russia jointly with the Federal Service of Counter-Intelligence of the Russian Federation with the Federal Border Service - with the Chief Commander of the border troops of the Russian Federation, Ministry of Foreign Affairs, Ministry of Transportation, Ministry of Railways, State Committee for Property and the Administration of the Krasnodar territory should take necessary measures for early establishment in 1994 immigration control posts and places of temporary accommodation of migrants, in check-points at the Russian-Georgian part of the state border of the RF, situated in the Krasnodar territory as well as in the airports and sea-ports of Adler, Novorossijsk and Krasnodar which possess international traffic connections for the sake of executing control over exit of foreign citizens and stateless persons including asylum-seekers or transit passengers.

The Ministry of Finance of the RF should secure financing expenses of the FMS of Russia on establishing in the Krasnodar territory immigration control posts and places of temporary accommodation of migrants in check-points at the state border of the Russian Federation at the expense of the Federal budget allocated for the realisation of the Federal Migration Programme.

To recommend to the Administration of the Krasnodar territory pending the establishment in the territory of immigration control posts at check-points of the state border of the RF jointly with the interested executive bodies to intensify the control over entry, stay and exit from the region of foreign citizens and stateless persons, to enforce the services charged with passport and visa control and to create conditions for its effective activities.

2. To recommend to the Administration of the Krasnodar territory jointly with the interested executive bodies and with participation of related departments of the Federal border service - the Chief of Border Troops of the RF and of the Ministry of Interior of the RF to intensify control over complying with the rules, regulating the regime of movement of all ships in the coastal waters.

3. The Ministry of Interior, the FMS jointly with the Administration of the Krasnodar territory should take the necessary measures to control the lawfulness of stay in the territory of foreign citizens and stateless persons, to take measures in the established order on deportation from the Russian Federation of foreign citizens and stateless persons who illegally stay in the Krasnodar territory. The above mentioned actions should be supported by financing at the expense of the federal budget within the limits of allocation provided for the execution of the Federal Anti-Criminal Programme and the Federal Migration Programme.

4. The FMS of Russia jointly with the Administration of the Krasnodar territory in the period of one month should fix the maximum possible number of displaced persons to be resettled in the territory in 1994.

The FMS of Russia jointly with the interested federal executive bodies and the executive bodies of the subjects of the Russian Federation in the period of two months should elaborate proposals concerning procedure for immigration quote of refugee and forced migrants' reception in different regions of the RF.

5. The MFA of RF, FMS, Ministry for National Affairs and Regional Policy in the period of three months should carry out negotiations with the MFA of the corresponding states:

•on bilateral agreements between the Government of the Russian Federation and the Government of the Armenian Republic, the Government of Azerbaijan, the Government of Ukraine concerning the regulation of migration and protection of rights of displaced persons,

•on joining of Georgia and Ukraine to the Agreement on Assistance to Refugees and Forced Migrants.

6. The MFA of RF, the Ministry of the RF in charge of Cooperation with the CIS Member-States, the Ministry of Interior, the FMS, Federal Border Service-Chief of Border Troops of the RF, Ministry of justice in the period of three months should draft and present to the Government of the Russian Federation proposals on amendments and additions to the current legislation concerning regulation of movement without visas on the territory of the Russian Federation of citizens of CIS states.

7. To recommend to the Administration of the Krasnodar territory to employ its own resources for additional financing of measures aimed at adjusting the migration situation in the Krasnodar Territory.
