Romania: Decision No. 807/1995 on the Amendment and Completion of Governmental Decision No. 417/1991 Regarding the Setting Up of the Romanian Committee for Migration Problems

The Government of Romania decides:

Article I

Governmental Decision No. 417.1991 regarding the setting up of the Romanian Committee for Migration Problems, published in Romania's Official Bulletin, Part I, No. 149 of 18 July 1991, and amended by Governmental Decision No. 58/1992, shall be amended and completed as follows:

1. Article 2 shall have the following contents:

"Article 2 The activity of the Romanian Committee for Migration Problems is coordinated by the Ministry of Interior."

2. Articles 6-1 and 6-2 shall be introduced after Article 6, with the following contents:

"Article 6-1 The activity of the RomanianCommittee for Migration Problems, concerning the receipt of applications for refugees status, interviewing of applicants, preparation of files for the Decision Commission, shall be carried out by the General Directorate of Passports, Aliens and Border Police of the Ministry of Interior.

Article 6-2 The evaluation of applications for refugees status in Romania shall be made by a Decision Commission, made out of representatives designated by: The General Directorate of Passports, Aliens and Border Police of the Ministry of Interior, the Ministry of Foreign Affairs and the Ministry of Labour and Social Protection."

3. Article 7 shall the following contents:

"Article 7

(1) The funds required for the board and meals of asylum-seekers and refugees receiving temporary assistance from the Romanian State shall be taken out the budget of the Government's General Secretariat, and they will be allotted through the prefectures.

(2) Asylum-seekers and refugees benefit of meals and board within the limit of Lei 5,100 and, respectively, Lei 1,600 by person per day. within the budgetary credits approved for this purpose for the Government's General Secretariat.

(3) The rights provided by para (1) shall be ensured to asylum-seekers for at most 6 months, and to refugees for at most 9 months. In exceptional cases, payment of accommodation for refugees may be approved beyond the limit of 9 months, within the annual budget which is allocated for this purpose.

(4) The time frame of granting the rights provided by para (1), within the limits provided by paras (2) and (3) shall be set by the Romanian Committee for Migration Problems, with the approval of the Government's General Secretariat.

(5) The Ministry of Interior shall recover, from the refugees who benefited from accommodation beyond the time limit of 9 months in the conditions provided by paras (3) and (4), the expenses incurred by the accommodation over the respective limit from the revenues achieved by those at later stages."

4. Article 10 shall have the following contents:

"Article 10 The manner in which the tasks of the Romanian Committee for Migration Problems and of local Committees are fulfilled, in line with the specific activity of each represented institution, shall be set by regulations approved by the Ministry of Interior."

5. The annex to Governmental Decision No. 417/1991, amended by Governmental Decision No. 58/1992, shall be integrated in this Decision.

Article II

This Decision shall enter in force within 15 days since publication in Romania's Official Bulletin.

Article III

Governmental Decision No. 417/1991, amended by Governmental Decision No. 58/1992 and by the present Decision, shall be republished in Romania's Official Bulletin, with the replacement, at article 6, of the title Ministry of Economy and Finance by Ministry of Finance, and with a renumbering of its articles.
