Lithuania: Instruction on Investigation of Foreigners' Applications for Granting Refugee Status in the Republic of Lithuania

1.      General part

1.1. This instruction determines the order for investigation and decision taking on foreigners' applications for granting refugee status in the Republic of Lithuania.

1.2. Foreigners' applications for granting refugee status are investigated according to the Convention on the status of refugee of 1951, the Protocol on the status of refugee of 1967, other international documents, the laws of the Republic of Lithuania, resolutions of the Government of the Republic of Lithuania and this instruction.

1.3. The foreigner has the right to submit the application for granting refugee status in the Republic of Lithuania according to the order determined by laws irrespective of his race, religion, nationality, political and other opinion, social origin, other conditions.

1.4. The foreigner, who applies for refugee status in the Republic of Lithuania, is obliged to obey and comply with the requirements of the Constitution and other laws of the Republic of Lithuania. The foreigner is responsible for the violations of the laws according to the order determined by the laws of the Republic of Lithuania.

1.5. Foreigners' applications for granting refugee status in the Republic of Lithuania can be accepted by border police control posts (further referred as to border police) of the Border Police Department to the Ministry of the Interior of the Republic of Lithuania and town(district) police commissariats (further referred as to police commissariats).

1.6. Border police, police commissariats inform and Migration Department to the Ministry of the Interior of the Republic of Lithuania (further referred as to Migration Department) which takes the decision on the legal status of the foreigner, applying for refugee status in the Republic of Lithuania, according to the legal instruments indicated in the paragraph 1.2.

1.7. Foreigners' Registration Centre investigates and Migration Department takes decisions on granting the temporary territorial asylum in the Republic of Lithuania.

1.8. Migration Department investigates foreigners' applications for refugee status in the Republic of Lithuania and the Minister of the Interior of the Republic of Lithuania grants or refuses refugee status.

1.9. Migration Department according to it's competence co-ordinates the activity of other sub-divisions of the Ministry of the Interior of the Republic of Lithuania involved in refugee status determination procedure.

2.      Submission of foreigners' applications for refugee status in the Republic of Lithuania

2.1. Foreigners' applications for refugee status in the Republic of Lithuania are accepted by:

2.1.1.          Border police;

2.1.2.          Police commissariats.

If the foreigner submits the application for refugee status in the Republic of Lithuania to other authorities not indicated in this paragraph, the local police commissariat should be informed immediately and accept the application. Police commissariat office which received the foreigner writes an official report and indicates the authority where the foreigner applied to, the institution that has sent him, also indicating his surname, first name, date of birth, citizenship, the country he is from, personal documents in possession, other necessary information.

2.2. Foreigner's application for refugee status in the Republic of Lithuania can be submitted in verbal or written form. Written application is of free form. Verbal application is written by the officer authorised to accept such an application according to the determined order. The foreigner has to sign the application.

2.3. Border police authorised officer, being received the foreigner's application for refugee status in the Republic of Lithuania:

2.3.1.          interviews the foreigner and completes the initial interview of the foreigner who applied for refugee status.

2.3.2.          takes from the foreigner travel passport, other documents confirming personal identity and travel tickets in possession.

2.3.3.          performs the personal search if the foreigner has no valid travel documents for entrance and stay in the Republic of Lithuania.

2.3.4.          immediately sends the copies of the application, sheet for initial interview, personal documents and travel tickets to the Migration Department;

2.3.5.          forms foreigner's personal file.

2.4. Authorised officer of police commissariat who receives foreigner's application for refugee status in the Republic of Lithuania:

2.4.1.          interviews the foreigner and completes the sheet for initial interview of the foreigner who applied for refugee status in the Republic of Lithuania;

2.4.2.          takes from the foreigner travel passport, other documents confirming personal identity and travel tickets in possession;

2.4.3.          performs the personal search if the foreigner entered the Republic of Lithuania illegally;

2.4.4.          immediately sends the copies of the application, sheet for initial interview, personal documents and travel tickets to the Migration Department;

2.4.5.          takes the photograph of the foreigner and his fingerprints;

2.4.6.          forms foreigner's personal file.

2.5. Official of the Migration Department being received the report and other documents of the foreigner who applied for refugee status in the Republic of Lithuania:

2.5.1.          investigates and takes a decision on the legal status of the foreigner in the Republic of Lithuania within 24 hours from the report reception; during the investigation of report the data about the foreigner should be verified from the computer data base of the Ministry of the Interior (previous convictions, personae non grata, population data base, address and inquiry office file, etc.)

2.5.2.          registers the decision officially in written form and sends it immediately by fax to the sub-division of the Ministry of the Interior which informed the Migration Department about the foreigner; if there is no possibility to send the decision by fax, the sub-division of the Ministry of the Interior is informed by phone, the decision is sent by post to the Foreigners' Registration Centre, and it's copy is sent to the sub-division of the Ministry of the Interior;

2.5.3.          registers foreigner's application for refugee status in the Republic of Lithuania in the registration book (appendix 2) and enters his data to the data base.

2.6. Officers of border police, police commissariats or Foreigners' Registration Centre detain and settle down the foreigner. If the foreigner has no valid documents for entrance and stay in the Republic of Lithuania, he is detained until the decision on the legal status of foreigner is received, but no more than for 48 hours.

2.7. If the foreigner is admitted into the territory or is granted the permission to stay in the Republic of Lithuania, the border police or police commissariat arranges for his transfer to the Foreigners' Registration Centre. Foreigner's personal file including foreigner's application for refugee status in the Republic of Lithuania, travel passport, other documents confirming personal identity, travel tickets, if they were present while presenting the application, sheet for initial interview, decision of the Migration Department on the legal status of foreigner, official report, if the foreigner has been handed over to police, should also be forwarded to the Foreigners' Registration Centre. Police commissariat adds to the foreigner's personal file four photographs of the foreigner of 35*45mm size and two fingerprint cards . If the foreigner has been detained in the Foreigners' Registration Centre, he remains here until it is established that there are no reasons, preventing the enjoyment of temporary territorial asylum in the Republic of Lithuania.

2.8. If the foreigner, who is detained at the border control post has not been admitted into the territory or refused the permission to stay in the Republic of Lithuania , he is not allowed to enter the territory of the Republic of Lithuania and is sent back to the country he came from. The foreigner detained at the police commissariat or at the Foreigners' Registration Centre is obliged to leave voluntarily or is deported from the Republic of Lithuania.

2.9. The foreigner who entered the Republic of Lithuania legally (possessing valid travel passport and visa for the Republic of Lithuania, if required) submits the application for refugee status in the Republic of Lithuania to border police or police commissariat; these institutions collect the documents indicated in paragraph no 2.3 and 2.4 and informs the Migration Department. If the foreigner has enough means for residence in Lithuania he is not obligated to stay at the Refugee Reception Centre to the Ministry of Social Security and Labour of the Republic of Lithuania (further referred as to Refugee Reception Centre) until his visa or permission for stay without visa is valid. After the validity of visa or permission for stay without visa expired, the Migration Department decides upon the residence of this foreigner and issues him the foreigner's registration certificate.

2.10.     The foreigner staying in the Republic of Lithuania legally and seeking asylum is obliged to inform the Migration Department about his place of residence in Lithuania, to present himself for interviews when required by the Migration Department or Foreigners' Registration Centre, to submit other necessary information. Migration Department informs the foreigner in written form in advance.

2.11.     If the foreigner refuses to comply with the requirements indicated in the paragraph 2.10, the Migration Department can take a decision on his settlement at the Refugee Reception Centre.

2.12.     If the foreigner, who entered the Republic of Lithuania legally and applied for refugee status in the Republic of Lithuania has no means for residence in the country he is forwarded to the Refugee Reception Centre.

2.13.     The interview of the foreigner who entered the Republic of Lithuania legally and applied for refugee status in the Republic of Lithuania is conducted, travel passport, other documents confirming personal identity, travel tickets, photographs and fingerprint are taken, personal file is formed and sent to the Migration Department by police commissariat on whose territory the foreigner has settled down or was settled by to the decision of the Migration Department.

3.      Granting of temporary territorial asylum in the Republic of Lithuania

3.1. The foreigners who entered and stay in the Republic of Lithuania illegally and applied for refugee status in the Republic of Lithuania shall be settled down in the Foreigners' Registration Centre separately from those who did not present such applications and those who were not granted temporary territorial asylum. The foreigners are obliged to obey the internal rules of the Foreigners' Registration Centre.

3.2. The Foreigners' Registration Centre is responsible for investigation related to the foreigner's who applied for refugee status travel route from his country of origin to Lithuania, to the circumstances of his arrival to Lithuania and to the personal identification. The Foreigners' Registration Centre may collect the information about the foreigner from different sources except the governmental institutions of his country of origin.

3.3. The Foreigners' Registration Centre takes photographs and fingerprints of the foreigners and also performs personal search if it had not been done before.

3.4. Fingerprint cards are sent to the Department of Criminalistic Expertise of the Ministry of the Interior. Fingerprints are entered to the data base in the Department. A copy of the cover letter is attached to the foreigner's personal file.

3.5. The foreigner who is staying at the Foreigners' Registration Centre has to fill in the questionnaire (appendix 3). If possible the questionnaire should in his mother tongue or in the language he is able to understand. If the foreigner is illiterate person the questionnaire is filled by the officer of the Foreigners' Registration Centre.

3.6. The questionnaire shall be filled in not later than the next day after foreigner's arrival to the Foreigners' Registration Centre.

3.7. If possible, the foreigners who arrived in Lithuania together shall fill in the questionnaires in separate premises at the same time.

3.8. If possible the questionnaires shall be translated into Lithuanian. Translation is organised by the Foreigners' Registration Centre.

3.9. The Foreigners' Registration Centre conducts the registration interview as soon as the foreigner arrives to the Foreigners' Registration Centre and fills in the questionnaire.

3.10.     Registration interview is conducted in the language that foreigner is able to understand. If needed the interpreter may participate in the interview. The interpreter is invited by the officer of the Foreigners' Registration Centre who is interviewing the foreigner.

3.11.     The interpreter shall know his functions during the interview, his duty to be impartial and keep professional secret. This is confirmed by his signature in appropriate place of filled questionnaire (appendix 4). Interpreter's questionnaire is attached to separate interpreters' file, held in the Migration Department.

3.12.     Before the registration interview the foreigner shall be informed about the purpose of the interview and the principle of confidentiality.

3.13.     It is strictly prohibited to use the means of physical and psychological pressure.

3.14.     The officer of the Foreigners' Registration Centre who conducts the interview summarises the information presented by the foreigner (appendix 5).

3.15.     At the end of the interview the summary shall be read to the foreigner and shall be signed by him on every page as to confirm the rightness of the summary.

3.16.     When the investigation is finished the Foreigners' Registration Centre prepares the draft of proposal to grant or refuse temporary territorial asylum (appendix 6,7) according to the article 4 of the Law on Refugee Status in the Republic of Lithuania and sends it to the Migration Department together with the foreigner's personal file within 30 days from the submission of application for refugee status in the Republic of Lithuania. This period can be extended by the decision of the Director of the Migration Department or his first deputy if Foreigners' Registration Centre presents motivated request.

3.17.     After examination of the file's documents and proposal, the Director of the Migration Department or the deputy official takes a decision on grant or refusal of temporary territorial asylum within fifteen days after the file has been received from the Foreigners' Registration Centre (appendices 8,9).

3.18.     The foreigner who is granted temporary territorial asylum in the Republic of Lithuania is issued with the foreigner's registration certificate by the Migration Department according to the determined order. After that the foreigner is transferred from Foreigners' Registration Centre to Refugee Reception Centre.

3.19.     If the foreigner is refused temporary territorial asylum in the Republic of Lithuania, the Migration Department, according to the determined order takes the resolution obliging the foreigner to leave the Republic of Lithuania or to deport him from the country. The reasons for refusal of temporary territorial asylum in the Republic of Lithuania should be indicated in the resolution.

3.20.     The foreigner is informed about the resolution for refusal of temporary territorial asylum in the Republic of Lithuania and decision obliging him to leave or to deport him from the Republic of Lithuania. The information can be announced in verbal form in the language that foreigner is able to understand. If requested by the foreigner, he is provided with a copy of resolution on refusal of temporary territorial asylum in the Republic of Lithuania in Lithuanian. The foreigner is also informed about the possibility to appeal against the decision on his deportation according to the order determined by the laws.

3.21.     If the complaint has not been satisfied the foreigner is obliged to stay in Foreigners' Registration Centre until his deportation from the Republic of Lithuania or issuance of another decision.

4.      Determination of Refugee Status in the Republic of Lithuania

4.1. During the investigation of the application on refugee status in the Republic of Lithuania, the foreigner who has been granted temporary territorial asylum in the Republic of Lithuania is obliged to stay in Refugee Reception Centre and obey the internal rules except in cases indicated in paragraph 2.10.

4.2. The interview of the foreigner on refugee status in the Republic of Lithuania is conducted by the officials of the Migration Department, who can also decide upon additional interviews to be performed.

4.3. The interview is conducted in the Refugee Reception Centre.

4.4. If necessary , the foreigner is allowed to use the interpreter's service during the interview. The interpreter is invited by the official of the Migration Department who conducts the interview.

4.5. The official of the Migration Department who conducts the interview and interpreter who participates in the interview have no right to disclose the information submitted by the foreigner unless the foreigner wishes or another order determined by the laws. The interpreter has to commit himself under the principal of confidentiality by signing in the appropriate place on the sheet for interview.

4.6. The official of the Migration Department who conducts the interview summarises the information submitted by the foreigner (appendix 10).

4.7. After the interview the summary is read to the foreigner who confirms it's rightness by signing on every page. If the foreigner supplements his statements they are summarised on a separate sheet.

4.8. The summary of the foreigner's interview is attached to his personal file.

4.9. If requested by the foreigner, he is provided with a copy of the summary of the interview.

5.      Decision taking

5.1. The officials of the Migration Department who investigate the foreigner's application for refuge status in the Republic of Lithuania prepare the drafts of resolutions (appendices 11,12) and agree them with the Director of the Migration Department or his first deputy.

5.2. The Director of the Migration Department or his first deputy submits the draft of resolution for the approval of the Minister of the Interior.

5.3. The foreigner's application for refugee status in the Republic of Lithuania shall be examined within six months after it's submission.

5.4. The time for the proposal of the resolution and the investigation of the foreigner's application for refugee status in the Republic of Lithuania may be extended due to objective reasons. The term of the investigation of the application may be extended by the Minister of the Interior only.

5.5. The foreigner is informed about the adopted resolution on grant or refusal of refugee status in the Republic of Lithuania. When refused refugee status in the Republic of Lithuania the foreigner is explained the reasons (in the language he understands) and the right of appeal against the decision. The information is presented in verbal form, and the copy of the decision in Lithuanian is given to the foreigner. The notice on the adopted decision is made in the foreigner's file (appendix 13).

5.6. The notice that the foreigner has been informed about the decision on grant or refusal of refugee status is made in the foreigner's personal file, indicating the date.

5.7. The resolution on refusal of refugee status can by appealed according to the order determined by the Law on Refugee Status of the Republic of Lithuania. The official of the Migration Department informs the foreigner about the right to appeal against the resolution.

6.      Issuance of personal documents

6.1. The foreigners who are granted temporary territorial asylum or refugee status in the Republic of Lithuania are provided with the following documents:

6.1.1.          foreigner's registration certificate (for the foreigner who is granted with the temporary territorial asylum in the Republic of Lithuania);

6.1.2.          permanent residence permit in the Republic of Lithuania (for the foreigner who is granted with refugee status in the Republic of Lithuania);

6.1.3           travel document of the refugee (for the foreigner who is granted refugee status in the Republic of Lithuania for those who wish to leave the Republic of Lithuania).

6.2. The order for the issuance, validity extension and nullification of these documents is determined by the regulations of the Ministry of Interior.

7.      The formation of the foreigners' personal files

7.1. The following documents shall be attached to the foreigner's personal file forwarded from Foreigners' Registration Centre to the Migration Department:

7.1.1.          the foreigner's application for refugee status in the Republic of Lithuania and it's translation to Lithuanian or the form of application for refugee status in the Republic of Lithuania completed by the official accepting the foreigner's application;

7.1.2.          sheet for initial interview;

7.1.3.          the official report of the officer who accepted application;

7.1.4.          travel passport and other documents, confirming personal identity, travel tickets and their copies if any while submitting the application;

7.1.5.          decision of the Migration Department on the legal status of foreigner in the Republic of Lithuania;

7.1.6.          protocol on personal search of the foreigner if he entered the Republic of Lithuania illegally;

7.1.7.          copy of the cover letter of the dispatch of fingerprints' cards to the Department Criminalistic Expertise of the Ministry of the Interior;

7.1.8.          completed questionnaire and it's translation to Lithuanian; the reasons for incomplete or non translated questionnaire shall be indicated in it(e.g. the foreigner is illiterate);

7.1.9.          summary of registration interview;

7.1.10.        proposal on temporary territorial asylum in the Republic of Lithuania;

7.1.11.        other documents related to the file.

7.2. All the data collected in the foreigner's personal file is confidential. The content of the file can not be disclosed or referred to another institution or another person who has no rights to get such information unless wished by the foreigner.

7.3. The Migration Department adds following documents to the file:

7.3.1.          resolution on grant or refusal of temporary territorial asylum in the Republic of Lithuania;

7.3.2.          summary of the interview of the foreigner (on refugee status in the Republic of Lithuania);

7.3.3.          resolution on grant or refusal of refugee status in the Republic of Lithuania indicating the reasons for the resolution;

7.3.4.          other documents related to the file.

7.4. If the decision for refusal of refugee status in the Republic of Lithuania is appealed to the Refugee Affairs' Board, his personal file can be referred to the Refugee Affairs' Board according to the order determined by the Migration Department and Secretariat of the Refugee Affairs' Board.

7.5. After the foreigner has been granted with refugee status in the Republic of Lithuania the first permission for permanent residence in Lithuania is issued by the Migration Department according to the separately determined order, and the Migration Office of the town(district) on which territory refugee resides extends the permission for permanent residence in the Republic of Lithuania upon the instruction of the Migration Department.

If the foreigner is refused refugee status in the Republic of Lithuania the Migration Department prepares the draft of resolution on deportation of the foreigner and submits it for the approval to the Minister of the Interior. This foreigner is staying in the Refugee Reception Centre pending the deportation or may be transferred to the Foreigners' Registration Centre. Deportation is executed according to the order determined by the Government of the Republic of Lithuania.

7.6. All the documents in the foreigner's personal file shall be in Lithuanian or their translations into Lithuanian shall be attached.

7.7. The files of the foreigners who applied for refugee status in the Republic of Lithuania are constantly kept in the Migration Department.

8.      Termination of the investigation of application for refugee status in the Republic of Lithuania

8.1. The investigation of application for refugee status in the Republic of Lithuania may be terminated if:

8.1.1.          the foreigner expresses his wish in written form for the file to be terminated;

8.1.2.          the foreigner leaves the Foreigners' Registration Centre or the Refugee Registration Centre and does not return for more than ten days;

8.1.3.          the foreigner commits a serious crime, court judgement is enforced and due to these reasons the foreigner is considered to be dangerous for the security of the Republic of Lithuania;

8.1.4.          the foreigner dies.

8.2. Decision on termination of the investigation of the application shall be taken by the Director of the Migration Department or deputy official.

8.3. The foreigner who expresses his wish to terminate the investigation, is obliged to submit the application for refusal of refugee status in the Republic of Lithuania (appendix 14).

8.4  .Pending deportation such foreigner is staying in the centre that he was located before the submission of the application. The foreigner whose visa is still valid or the permitted term of residence without visa is not expired can be obliged to leave the country. The control of his departure is directed to the police commissariat on whose territory he temporary lived or to Foreigners' Registration Centre.

8.5. When received the application on termination of the investigation of the application for refugee status in the Republic of Lithuania, the Migration Department officially registers the documents on obliging for departure or deportation of the foreigner from the Republic of Lithuania.

8.6. If the foreigner returns to the centre after more than ten days, the investigation of his file is renewed from the beginning except the cases when he was absent due to objective reasons. Decision on the resumption of the investigation of the file is taken by officials indicated in paragraph 8.2. In this case the time when the file was discontinued is not included into the term of the investigation of the file.

8.7. In case of cessation of the foreigner's right for refugee status according to the article 6 of the Law on Refugee Status in the Republic of Lithuania, the Migration Department prepares the draft of resolution and submits it for approval to the Minister of the Interior.

8.8. Migration Department authorises the police commissariat on which territory the foreigner resided or the Foreigners' Registration Centre to control the foreigner's departure from the country. Report about the foreigner's departure is sent to the Migration Department.

9.      Registration of refugees and asylum seekers

9.1.       The computer data base is formed for the registration of refugees and foreigners who submitted applications for refugee status in the Republic of Lithuania. It is managed according to the separately determined order.

9.2.       The Migration Department is responsible for the data base.

9.3.       The right to use the data base (to enter, to edit data and to perform it's search) is vested solely to the Migration Department.

9.4.       The Migration Department annually but not later than the 1st of March sends the annual statistical information about the foreigners who applied for refugee status in the Republic of Lithuania to the Headquarters of the Ministry of the Interior.
