Yemen: Republican Decree No. 260 of 2003 Concerning the Executive Regulation of the Law of Nationality

Republican Decree No. 260 Concerning the Executive Regulation of the Law of Nationality issued on Friday 18th Shawwal 1424 Hijryyah corresponding to 12th of December, 2003.

A Republican Decree was issued yesterday under number 260 for the year 2003 to include an article to the Republican Decree No. 3 for the year 1994 concerning executive regulation for the Law of nationality.

The first article of the above law stipulated inclusion of a new article under number (6 - repeated) of the Law No 3 for the year 1994 concerning executive regulation for the law of the Yemeni nationality. The new article text should read as follows;

Article (16 – repeated) children of a Yemeni mother married to a foreigner husband should be treated as Yemenis from all aspects namely including them in the mother's passport or granting them with passports in the following cases:

1.                  If mother has to take care of the children because of being divorced or absence of father or when father discontinues living with them in Yemen for a period not less than a year.

2.                  Death of father,

3.                  If father is getting crazy.

The above cases should be well-authenticated by means of the following documents and statements as required:

A/        A medical certificate issued by the respective authority confirming father's status of being crazy. 

B/         An official death certificate issued by the respective authority confirming death of father.

C/1      When children reached the age of adulthood. As per any of the above paragraphs of this article, children have a choice either to get the Yemeni nationality or to join in the nationality of their father.

C/2      the choice of getting the Yemeni nationality is to be confirmed by a legal judgment.

C/3      Minister of Interior is to grant children of a Yemeni mother from a foreigner husband who meet conditions outlined herein this article with an entry document to the Yemeni nationality.

The second article of this law stipulated enforcement of the above as date of issue and to be published in the Gazette.
